Service Terms, Booking Conditions and Contract

The below booking conditions form part of the contract between the travel participant(s) or travel sponsor accepting on behalf of all travelers referred to below as ‘You’, Your’, ‘The Client’, ‘Traveler’, ‘Passenger’, or ‘Guest’ and GUIDED SAFARIS, INC. (Limited Liability Corporation), a registered Seller of Travel in the State of California (referred to below as ‘GUIDED SAFARIS INC’, ‘GUIDED SAFARIS’, ‘we’, ‘us’ and ‘our’) for all quotations received or travel arrangements reserved.

Prices are subject to change without any prior indication due to increase in airfares, transport, hotel rates, exchange rates, government tax etc. GUIDED SAFARIS reserves the right to cover increased costs, tariffs & taxes and to reflect fluctuations in foreign exchange markets. For all reservations made over 90 days prior to departure, a deposit of 50% of the total per person trip cost as outlined in your itinerary is required at the time of reservation. Full payment is required 90 days prior to departure from your home city. GUIDED SAFARIS reserves the right to cancel bookings for which full payment has not been received 90 days prior to departure. Update: Special Event Travel Payment Terms: Due to any special circumstance of a special event season in Africa, standard airline and hotel rules may change for reservation hold and trip payment will be requested IN FULL at the time of reserving your travel to hold all bookings secure.

1. Cancellation Policy:

Cancellations received upto 90 days prior to departure will be subject to a cancellation charge of 50% of the per person trip cost per booking. Cancellations received less than 90 days prior to departure will be subject to the following forfeit of tour cost:
Upto 90 days - 50% of trip cost
89 to 61 days – 75% of trip cost
60 to 0 days – 100% of trip cost

2. Limitation of liability:

The client understands that Guided Safaris Inc. is not the source or supplier of the travel services requested, and acts solely as an agent for the actual suppliers of such services. Client is advised that the suppliers whose names appear in the itinerary information supplied (such as hotels and airlines) are those who are actually responsible for providing the travel services purchased. Client consents to and requests the use of those suppliers and agrees not to hold Guided Safaris Inc responsible should any of these suppliers: i.) fail to provide the travel services purchased; ii.) fail to comply with any applicable law; or iii.) engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience. Client accepts that Guided Safaris Inc. is not responsible for, nor will client attempt to hold it liable for, any injury, damage or loss suffered by travelers on account of any conditions, actions or omissions that are beyond its reasonable control. Client will review travel documents for accuracy upon receipt and understand that they may contact Guided Safaris Inc if they have any questions. Client understands that discounted fares typically involve restrictions and that changing any aspect of travel arrangements may result in the payment of additional money. Client understands that if traveling internationally, all travelers must have a valid passport and depending upon their destination and nationality, client may need to obtain one or more visas. Passport and visa information may be obtained by contacting the Travel Advisory Section of the U.S. State Department at 202.647.5225 or by visiting the State Department’s Web site at www.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements.

3. Refund for unused services:

No refund or exchange can be made in respect to accommodation, meals, sightseeing tours, transport or any other services, which are included in the travel package rate but not utilized by the traveler.

i.) California law requires Sellers of Travel to have a trust account or bond. Guided Safaris, Inc. has a trust account. Upon cancellation of the transportation or travel services, where the traveler is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to the Seller of Travel for services not provided will be promptly paid to the passenger, unless the passenger advises the Seller of Travel in writing, after cancellation. This provision does not apply where the Seller of Travel has remitted the payment to another registered wholesale Seller of Travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.

ii.) This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in the TCRF at the time of sale and the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000.

iii.) A Claim must be submitted to the TCRF within six months after the scheduled completion date of travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating Seller of Travel for matters arising out of sale for which you file a TCRF claim. iv.) For passengers purchasing from outside of California this transaction is not covered by the California Travel Consumer Restitution Fund.

4. Transportation:

The airlines & other carriers concerned provide transport timings. They are subject to change as a result of air traffic control restrictions, weather conditions, operational/maintenance requirements & the requirement for passengers to check in on time. GUIDED SAFARIS cannot be held responsible for if there is any change to a departure or arrival time shown in their website, tours or on any ticket. Similarly, we cannot make any special arrangements for you if you are delayed since such matters are at the sole discretion of the airline or any other carrier concerned.

5. Insurance:

We recommend that you take the following travel insurances prior to your departure:
- Trip Cancellation and Interruption (Must cover our cancellation terms as listed in Section 1)
- Baggage Delay, Loss & Pilferage
- Medical & Emergency Evacuation
- Accidental Death & Disability

6. Participation:

Please ensure that you take all appropriate medical advice prior to departure as to whether or not you are fit enough to take the trip booked. Persons not fit for long trips due to age, disease, chronic illness, physical handicap, advance pregnancy or mental illness should not participate in these rigorous travel programs. Please consult your physician for advice on the appropriate Malaria prophylactics available prior to departure. Please note Guided Safaris is unable to provide advice or suggestions on Malaria prophylactics and whether or not they would be advisable based on your medical history. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s Web site at www.cdc.gov. Client understands that they may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

7. Risks & Indemnity:

GUIDED SAFARIS draws your attention to the fact that there are certain inherent risks involved in participating in the type of trips sold by GUIDED SAFARIS and that you accept them at your own risk. Safaris involve close encounters with wild animals during game activities as well during stays at camps/lodges as all properties remain unfenced so as not to disrupt animal migratory patterns. Travelers are advised to follow the advice and guidance of the camp managers and game rangers while on safari and practise all safety procedures outlined. All travelers acknowledge that they are fully aware of and appreciate the dangers and risks that are associated with game reserves and/or game lodges arising from the presence of wild and dangerous animals, reptiles, birds and insects and the risk of suffering bodily harm, injury, death and/or loss which may arise as a result of an encounter with and/or the presence of wild animals and/or reptiles and/or birds whilst on safari.

8. Force Majeure:

This means, in relation to GUIDED SAFARIS, any circumstances beyond the reasonable control of GUIDED SAFARIS [including but without limitation, acts of Nature, explosion, flood, tempest, fire, accident, war or threat of war, sabotage, terrorism, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions or other untoward occurrences. If GUIDED SAFARIS is affected by Force Majeure it shall notify you of the nature and extent thereof. GUIDED SAFARIS shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance or by non performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.

9. Airline clause:

Airlines are not to be held responsible for any act, omission, or event during the time passengers are not onboard their planes or conveyances. International air carriers are also subject to international air conventions limiting their liability. These limitations are explained on the reverse side of the airline ticket which, when issued, constitutes the sole contract between the airlines and their passengers.

10. Flight confirmations:

Please re-confirm your onward flights with the outgoing carrier at least 72 hours prior to departure.

11. Special requests:

Your special request (e.g. Diet, particular room, seating etc.) should be put in writing. We shall forward it to our suppliers, however no special request can be guaranteed.

12. Travel Documents:

It is the sole responsibility of the customer to ensure that his/her travel documents, visa, inoculations etc. are in order prior to departure. GUIDED SAFARIS is not liable if you fail to have the required documents.

13. Alterations & Delays:

Although unlikely, we may occasionally have to change or cancel your travel arrangements and we reserve the right to do so at any time. This could be due to prevailing conditions or unforeseen circumstances. Guided Safaris does not hold itself liable for delays prior to departure or during the course of any travel, whether brought about by unforeseen contingency or other causes beyond our control.

14. Luggage:

Luggage is restricted to 20kg (44 lbs) maximum per person and only soft duffel bags will be accepted (no hard suitcases / attaches can be transported as they physically cannot fit into the aircraft). Weight allowance includes camera equipment and hand luggage.

15. Passenger Weight:

All passengers weighing 100kg (220 lbs) or more must advise us in advance as an extra seat will then have to be costed into the package for aircraft configuration and passenger safety purposes.

16. Consent:

The advance payment OR any other partial payment for a reservation on a travel package constitutes consent to all provisions of this contract. The terms under which you agree to take these travel services cannot be changed or amended except in writing signed by an authorized officer of GUIDED SAFARIS.

17. Responsibilities:

The right is reserved to alter or modify itineraries or hotel accommodation in any way necessary, and to cancel the same without any notice in the interest of the tour members. GUIDED SAFARIS ACT ONLY AS A BOOKING AGENT FOR VARIOUS COMPANIES AND HAS NO LIABILITY WHATSOEVER FOR ANY ASPECT OF THE ARRANGEMENTS AND, IN PARTICULAR, HAS NO RESPONSIBILITY FOR ANY DEATH, PERSONAL INJURY, DELAY, DAMAGE, ACCIDENT OR LOSS OF WHATEVER NATURE YOU MAY SUFFER. There will be no compensation from changes or cancellation if the same are due to natural disasters, civil disturbances, quarantine etc. of which we have no control. GUIDED SAFARIS is not liable for any act of omission, default or defect of themselves, their employees and agents, for any loss, damage or injury to persons or goods however they may be caused and also for the accuracy of any information forwarded by the travel services of their agents.

YOU HEREBY DECLARE THAT YOU HAVE FULLY READ, UNDERSTOOD AND ACCEPT THE ABOVE BOOKING CONDITIONS ON BEHALF OF ALL TRAVELERS ACCOMPANYING YOU ON THIS TRIP. NOTE: ANY TRAVELER WHO SIGNS THIS SERVICE CONTRACT ON BEHALF OF ANY OTHER TRAVELER PARTICIPATING IN THE SAME TRIP WARRANTS TO GUIDED SAFARIS INC. THAT HE / SHE HAS FULL AUTHORITY TO DO SO ON BEHALF OF THAT TRAVELER.

Purchases; Other Terms and Conditions Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site, including contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Site or for any service offered on or through the Site, the latter terms shall control with respect to your use of that portion of the Site or the specific service. Indemnity You agree to indemnify and hold Guided Safaris, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Guided Safaris by any third party due to or arising out of or in connection with your use of the Site.

Violation of These Terms of Use Guided Safaris may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Guided Safaris’ rights or property, or the rights or property of visitors to or users of the Site, including Guided Safaris’ customers. Guided Safaris reserves the right at all times to disclose any information that Guided Safaris deems necessary to comply with any applicable law, regulation, legal process or governmental request. Guided Safaris also may disclose your information when Guided Safaris determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Guided Safaris, for which monetary damages would be inadequate, and you consent to Guided Safaris obtaining any injunctive or equitable relief that Guided Safaris deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Guided Safaris may have at law or in equity. You agree that Guided Safaris may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems. If Guided Safaris does take any legal action against you as a result of your violation of these Terms of Use, Guided Safaris will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Guided Safaris. You agree that Guided Safaris will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

Governing Law; Dispute Resolution You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by International Trade laws, laws of the United States and by the laws of the State of California without regard to its conflicts of laws provisions.
