These Terms and Conditions of Use (the “Terms of Use”) apply to the Guided Safaris, Inc. website located at www.luxurysafaricamps.com and www.luxurysafarilodges.com, and all associated sites linked to www.LuxurySafariCamps.com or www.LuxurySafariLodges.com by Guided Safaris, Inc., its subsidiaries and affiliates, including Guided Safaris sites around the world (collectively, the “Site”).
The Site is the property of Guided Safaris Inc. (“Guided Safaris”). BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE. Guided Safaris reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. IT IS YOUR RESPONSIBILITY to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

CLIENT AGREEMENT
“I, the client, acknowledge that I have voluntarily applied for the trip as specified above. I understand that I may travel to remote countries and areas in Africa that are inherently risky including the stated destinations in my itinerary. I am prepared to assume the risks associated with this trip including: forces of nature; pandemic, epidemic, plague, weather; terrorism; civil unrest; war; strikes; local laws; accidents; and all transportation including land vehicles, boats and aircraft that are not necessarily operated or maintained to standards found in North America. I assume all risks associated with altitude, illness, physical injuries sustained, disease, alcohol consumption, physical exertion and sporting activities, knowing that access to evacuation and/or suitable medical supplies and support may not be available. I also assume full responsibility for my own baggage and personal possessions and effects. Guided Safaris, Inc., including its officers, directors, shareholders, employees, agents and successors, does not own or operate any entity which is a service provider for client journeys. I understand and agree that Guided Safaris purchases all transportation, accommodation, dining and all other services from a variety of independent entities. I understand and agree that Guided Safaris is not responsible or liable for the gross negligence or intentional acts by any service provider or other third party. I agree that I am responsible for purchasing comprehensive travel insurance and emergency medical insurance that will cover all expenses related to trip cancellation; missed connection, illness, change of mind to travel, loss of luggage and personal effects; medical expenses including evacuation; and all other issues related to personal reason, personal injury, death, property damage, or other loss, accident, delay, inconvenience or irregularity which may be occasioned by reason of (1) any wrongful, negligent, willful or unauthorized acts or omissions on the part of any service provider including airlines, hotels and restaurants, or their employees or agents or any other third party (2) any defect or failure of any vehicle, equipment, aircraft or instrument owned by any service provider (3) any wrongful, negligent, willful or unauthorized acts or omissions on the part of any third party. I understand that unforeseen events beyond the immediate control of Guided Safaris may occur, such as flight/train/boat/other transportation cancellations, destination issues, weather issues, political issues, hotel issues/problems, and other unexpected schedule changes. I agree that Guided Safaris is not responsible for such unanticipated and uncontrollable changes, and that any expenses resulting from such changes (e.g. additional hotel, transportation, or guide fees, etc.) would be my sole responsibility, and I further understand that I may be eligible to recoup such costs from my chosen travel insurance carrier. I hereby agree that everyone in my party, including myself, is of adequate health, and no one has any physical condition or disability that could prevent them from taking part in the journey or present a hazard to themselves, or have, hereby, disclosed any conditions that may hinder our/my ability to endure the exertions of this trip. By accepting this document I agree to take full responsibility for my own and the members of my party’s actions, safety and welfare, including unanticipated events including injury, illness, theft, emotional trauma, death, forces of nature, war and terrorism. I hereby release and discharge Guided Safaris, Inc. and its agents and employees from and against any and all liability arising from my participation in the above trip. I agree that this release will be legally binding upon me, my heirs, successors, assigns and legal representatives, it being my intention to fully assume all risk of travel and to release Guided Safaris, Inc. from any and all liabilities to the maximum extent permitted by law. For information concerning entry requirement, visa or inoculations to the destinations applicable, Guided Safaris recommends contacting the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, Guided Safaris recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. I assume full and complete responsibility for checking and verifying any and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s) prior to putting down a trip deposit. It is my choice and responsibility to obtain any vaccinations or medications for travel and will consult my medical professional familiar with my health history if these are advised for my health conditions. Any issues or claims relating to terms and conditions or in any way relating to the journey shall be settled by binding arbitration in the State of California, in accordance with the current rules of the American Arbitration Association.”
CLIENT AGREEMENT FOR ALL CREDIT CARD PAYMENTS:
“I, the cardholder named in the Guided Safaris credit card authorization document, accept that my deposit payment is non-refundable and all payments received by Guided Safaris, Inc. (CST # 2090406 40) for the travel services purchased on the indicated credit card constitute my acceptance of the Guided Safaris Booking Contract & Service Terms on behalf of each traveler participating in the trip being purchased, whether or not I accompany them on the trip. I further accept that upon receipt by Guided Safaris, Inc. of the signed and dated Credit Card Authorization form all travelers are subject to the Guided Safaris Inc Service Conditions and Cancellation Terms provided. I verify that all information on the Credit Card Authorization is correctly provided, and that I, the signed Cardholder, am the cardholder of the above credit card. My signature also implies that I, the cardholder and/or my travel companions agree not to request any charge backs on the credit card until any disputed matters are resolved with Guided Safaris, Inc. and travel service providers that have undertaken this booking. I further verify that the signature above is my signature as indicated on the reverse of the above-indicated card. I acknowledge that full payment is required per the dates specified in payment terms attached to my confirmed itinerary and that GUIDED SAFARIS reserves the right to CANCEL bookings without refund for which full payment has not been received by the dates outlined in the payment terms. I also accept that if any payment is withheld by my refusal to pay or by the credit card issuing company, or a bank, either due to limits on the type of credit card held, invalid account balance, insufficient availability of funds or ANY other reason stated by the bank, credit card authorizer or merchant service, this payment must then be made to Guided Safaris via an alternative functional credit card on the same day or EXPEDITED VIA SAME DAY BANK WIRE, PLUS any late payment fee or changes in pricing stipulated by Guided Safaris when such payments are not duly processed on account of credit card limitations. “
CLIENT BOOKING TERMS
The advance payment, all forms of deposit OR any other partial payment for a reservation on a travel package constitutes consent to all provisions of the standard Guided Safaris Booking Contract as attached to this document. These standards terms under which you agree to purchase Guided Safaris services are non-negotiable.
These booking conditions form part of the contract between the Client, travel participant(s), primary cardholder or trip sponsor, referred to below as ‘You’, Your’, ‘The Client’, ‘Traveler’, ‘Passenger’, ‘Primary Cardholder’ or ‘Guest’ AND GUIDED SAFARIS, INC., a registered Seller of Travel in the State of California (CST. 2090406 40), referred to below as ‘GUIDED SAFARIS INC’, ‘GUIDED SAFARIS’, ‘we’, ‘us’ and ‘our’, for all travel arrangements reserved on behalf of the Client.
The non-refundable deposit and current trip total amount to be paid by or on behalf of the travelers for the services is as quoted to the traveler and stated on Page 1 of the Booking Form and Contract provided to the Client, as agreed upon and signed by the Client, Traveler, or Primary Cardholder, in the Guided Safaris Booking Consent and Credit Card Authorization form, plus any amendments or additions of services to the finalized itinerary as requested by the Client. While not a normal occurrence, prices are subject to change without any prior indication by suppliers due to increase in rates, airfares, transport rates, exchange rates, government tax or newly-imposed levy, VAT implementation etc, which are outside our reasonable control. GUIDED SAFARIS reserves the right to cover increased costs, tariffs & taxes and to reflect fluctuations in foreign exchange markets. GUIDED SAFARIS reserves the right to cancel bookings for which full payment has not been received by the dates outlined in the payment terms. For all payment via credit card: Travelers understand that if any payment is withheld by the credit card issuing company, or bank, either due to the type of credit card held, invalid account balance, insufficient availability of funds or any other reason supplied by the credit card authorizer or merchant service, travel payment must then be expedited to GUIDED SAFARIS via an alternative functional credit card, or overnight check, or expedited bank wire within the next day, plus any late payment fee or changes in pricing where applicable when such payments are not duly processed on account of your credit card status or lack of funds.
1. Cancellation Policy: All trip payments are non-refundable. Cancellations policies for each trip are outlined in your issued Travel Documentation and Guided Safaris Payment Invoice.
2. Limitation of liability: The client understands that GUIDED SAFARIS is not the source or supplier of the travel services requested, and acts solely as a reservation agent for the actual suppliers of such services. Client is advised that the suppliers whose names appear in the itinerary information supplied (such as hotels and airlines) are those who are responsible for actually providing and carrying out the travel services purchased. Client consents to and requests the use of those suppliers and agrees not to hold GUIDED SAFARIS responsible should any of these suppliers: i.) fail to provide the travel services purchased; ii.) fail to comply with any applicable law; or iii.) engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience. Client accepts that GUIDED SAFARIS is not responsible for, nor will client attempt to hold it liable for, any injury, damage or loss suffered by travelers on account of any conditions, actions or omissions that are beyond its reasonable control. Client will review travel documents for accuracy upon receipt and understand that they may contact GUIDED SAFARIS if they have any questions. Client understands that special elements of trip cost such as Gorilla permits air fares and special hotel packages are non-refundable from the time of first payment made for any trip purchase. Client understands that discounted fares typically involve restrictions and that changing any aspect of travel arrangements may result in the payment of additional money. Client understands that if traveling internationally, all travelers must have a valid passport and depending upon their destination and nationality, client may need to obtain one or more visas and in special cases, such as travel with minors or adopted children, special requirements or inoculations must be acquired depending on the destinations visited and it is the sole responsibility of the Client to research and be aware of these entry requirements. For security purposes, GUIDED SAFARIS does not assist with Passport, Visa applications or medical / vaccination advise, as these fall under the responsibility of the traveler to ensure that the requirements for entry are met for their final destinations based on their personal immigration status for each destination. Passport and visa information may be obtained by contacting the Travel Advisory Section of the U.S. State Department at 202.647.5225 or by visiting the State Department’s Web site at www.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entry requirements. Client must ensure that all passports are valid for 6 months to the point of return to the home country and that all passports have available the mandatory blank pages marked ‘VISA’ at the top (4 empty sides: 2 facing blank leaves) as necessary for South Africa plus additional VISA pages per each African Country visited, European entry, or other transit point. Each entry to a country requires entry stamps for which passports must have available sufficient blank pages marked ‘VISA’ at the top or this will prove difficulty and possible rejection of boarding aircraft or gaining entry at a border thereby interrupting a trip. Travel insurance does not cover immigration eventualities on barred entries so it is mandate that Travelers call their local consulate to determine the entry requirements for each destination based on their nationality. Travelers may be refused boarding or disembarked from a vessel without liability for refund, payment, compensation or credit of any kind if they or their companions do not have necessary or proper documentation, and the Client will be subject to any fine or costs incurred by Guided Safaris which result from their lack of or improper provision of documentation or noncompliance with applicable regulations.
3. Insurance: It is a requirement of all safari camps that travelers carry travel insurance prior to their departure to protect their personal safety and trip investment. The following coverages are recommended: Trip Cancellation and Interruption, Medical & Emergency Evacuation, Accidental Death & Disability, Baggage Delay, Loss & Pilferage. If a Client declines or decides against the purchase of any form of travel insurance he or she assumes all responsibility for own travel risk protection and emergency arrangements if encountering problems or personal losses before, during or after the trip regarding these services or destinations and accepts that if any emergency assistance is required with re-scheduling, re-planning or re-routing services due to interrupted travel, regardless of cause or reason, that they and all travel companions without any form of trip cancellation or trip interruption protection insurance assume out of pocket expense to resolve their travel arrangement and the Client will be charged an emergency assistance fee where applicable. The Traveler also assumes responsibility for any applicable out of pocket expenses, cancellation penalties or change fees as charged by the airlines, hotels or other suppliers at time of such change of travel plans or emergency.
4. Refund for unused services & Limitation of Liability:
No refund or exchange can be made in respect to accommodation, meals, sightseeing tours, transport or any other services, which are included in the travel package rate but not utilized by the traveler for whatever reason. There will be no compensation from changes, change of mind or cancellation if the same are due to health concerns, natural disasters, civil disturbances, quarantine etc. of which the suppliers concerned have no control. GUIDED SAFARIS is not liable for any act of omission, default or defect of themselves, their employees and agents, for any loss, damage or injury to persons or goods however they may be caused and also for the accuracy of any information forwarded by the travel services of their agents. Seller of Travel Program and Declaration of T.C.R.F: California law requires Sellers of Travel to have a trust account or bond. GUIDED SAFARIS, INC. has a trust account (CST # 2090406-40). Please be advised that the State of California has established a Travel Consumer Restitution Fund (T.C.R.F) pertaining to domestic travel purchased in the United States by residents of California and this is the statement we are required to provide to travelers, under the law: “T.C.R.F. does not cover non-California residents, and even in the case of California residents, T.C.R.F. does not cover ANY foreign travel where the foreign “Providers of transportation of travel services” are not in compliance with the Seller of Travel law (compliance being defined as: Registered as a Seller of Travel in California and a Participant in the Travel Consumer Restitution Fund). Since GUIDED SAFARIS, INC. is a California Corporation we are required to inform travelers of the existence of T.C.R.F. yet at the same time inform travelers that it does not apply to this particular service and travel package where the suppliers are foreign corporations that do not conform to T.C.R.F. Thus none of the trips offered by GUIDED SAFARIS, INC. are applicable to T.C.R.F and by law travelers are required to be advised that they would not be eligible to make any claim from T.C.R.F in the unlikely event of default by GUIDED SAFARIS, INC. or any of the foreign suppliers rendering these services.” Travelers understand that they must purchase travel insurance to fully protect their trip investment from supplier bankruptcy and default.
5. Transportation:
Airlines and other carriers concerned provide transport timings. Per the conditions and terms of carriage listed on any airline website that form a direct agreement between the passenger and airline, or where applicable the terms on the eticket documents issued, services are subject to change as a result of international and domestic air traffic control restrictions, weather conditions, operational /maintenance requirements & the requirement for passengers to check in on time. GUIDED SAFARIS cannot be held responsible for if there is any change to a departure or arrival time shown in their website, itinerary or on any ticket. Similarly, we cannot make any special arrangements if a Traveler is delayed since such matters are at the sole discretion of the airline or any other carrier concerned. Per the terms of carriage of any international and domestic carrier: Airlines are not to be held responsible for any act, omission, or event during the time passengers are not onboard their planes or conveyances. International air carriers are also subject to international air conventions limiting their liability. These limitations are explained on the reverse side of the airline ticket or on the companies’ official websites which constitutes the sole contract between the airlines and their passengers. Please re-confirm your onward flights with the outgoing carrier at least 72 hours prior to departure. Traveler understands that they may purchase travel insurance to cover for missed connections.
6. Participation:
Travelers understand that they must purchase travel insurance incase of inability to travel due to a health concerns, medical reasons or personal emergency. Travelers undertake to ensure that they will seek all appropriate professional medical advice prior to departure as to whether or not they are fit enough to take the trip booked. Persons not fit for long trips due to age, disease, medical operation, illness, physical handicap, advance pregnancy or mental illness should NOT participate in these rigorous travel programs. Travelers must consult a physician for advice on the appropriate Malaria prophylactics available prior to departure: GUIDED SAFARIS is not a licensed medical professional and is unable to provide advise, share any recommendation or suggestions on Malaria prophylactics or vaccinations and whether or not they would be advisable based on travelers’ medical history. 7. Risks & Indemnity: Per the standard indemnity clauses issued by all adventure retreats and game lodgings in your itinerary, GUIDED SAFARIS draws your attention to the fact that there are inherent risks involved in the destinations visited and that you accept them at your own risk. All adventure travel and safaris involve close encounters with wild animals during game activities as well as during stays at camps/lodges since all properties remain unfenced so as not to disrupt animal migratory patterns and retain the authenticity of the wilderness experience. Travelers are advised to follow the advice and guidance of the camp managers and game rangers while on safari and practice all safety procedures as outlined. All Clients acknowledge that they are fully aware of and agree to participate in these journeys given the reasonable dangers and risks that are associated with game reserves and/or game lodges arising from the presence of wild and dangerous animals, reptiles, birds, vegetation and insects and the risk of suffering bodily harm, injury, death and/or loss which may arise as a result of an encounter with and/or the presence of wild animals and/or reptiles and/or birds and/or vegetation whilst on safari.
8. Force Majeure:
This means, in relation to GUIDED SAFARIS, any circumstances beyond the reasonable control of GUIDED SAFARIS [including but without limitation, acts of Nature, explosion, flood, tempest, fire, accident, war or threat of war, sabotage, terrorism, civil disturbance, requisition, sickness, quarantine, epidemic, government intervention, weather conditions or other untoward occurrences. The right is reserved to alter or modify itineraries or hotel accommodation in any way necessary, and to cancel the same without any notice in the interest of Guest safety. If GUIDED SAFARIS is affected by Force Majeure it shall notify you of the nature and extent thereof. GUIDED SAFARIS shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. Traveler understands that they should purchase travel insurance to protect their trip investment.
9. Special requests:
Special requests (e.g. diet, check in, check out, allergies, specific room, seating, etc.) must be put in writing to GUIDED SAFARIS. We shall forward it to our suppliers, however, no provision of a special request is ever guaranteed and remains at sole discretion of the camps, hotels or airlines concerned and their ability to fulfill the request.
10. Luggage & Passenger weight:
Luggage is restricted to 20kg (44 lbs) for South Africa or 15kg (33lbs) for East Africa maximum per person and only soft duffel bags will be accepted (no hard suitcases or attaches may be transported). Weight allowance includes camera equipment and hand luggage. All passengers weighing 100kg (220 lbs) or more must advise GUIDED SAFARIS in advance as extra seating will need to be invoiced by airlines to Travelers for aircraft configuration and passenger safety purposes on the smaller aircraft and helicopters to camps and islands.
11. Physical Fitness for Adventure Travel & Guest Conduct
Clients acknowledge and understand that adventure travel requires reasonable to high levels of fitness depending on the selected activity. To participate in any trip as intended, clients must ensure a reasonable level of sound health and ability for active fitness as required. Guided Safaris requires advance notice if any client or travel participant has any kind of physical impairment or other condition or disability that could impair the client’s ability to participate in a journey or that may pose as a hazard to the client themselves or any other traveler. Guided Safaris reserves the right to decline participation by anyone whom it considers unsuitable due to fitness level. By trip purchase or through payment of any form of deposit, the client certifies that they have ensured that neither they nor anyone traveling with the client has any physical or other condition or disability that could create a hazard to themselves or burden other members of the trip. Guided Safaris reserves the right to decline acceptance of anyone whom it considers unsuitable on the safari due to fitness level or illness. Guided Safaris and its travel service providers, guides, pilots and lodge managerial staff also reserve the right to remove from the trip, at the participant’s own expense, anyone whose physical condition or conduct negatively impacts the enjoyment of the other guests, creates a nuisance or jeopardizes safety while in the presence of wildlife or disrupts the safari. For special activities such as Gorilla tracking any guests exhibiting signs of respiratory or flu symptoms will not be allowed to participate in any activity in the park at the discretion of the guide. No refund or compensation will be issued under any such criteria requiring the dismissal of a client from a trip or activity, whether due to client’s personal constraint in choosing so or under supervisory intervention.
ALL TRAVELERS HEREBY DECLARE THAT THEY HAVE FULLY READ, UNDERSTOOD AND ACCEPT THE ABOVE GUIDED SAFARIS, INC. BOOKING CONTRACT AND TERMS. ANY TRAVELER WHO ACCEPTS THIS SERVICE CONTRACT ON BEHALF OF ANY OTHER TRAVELER PARTICIPATING IN THE SAME TRIP WARRANTS TO GUIDED SAFARIS INC. THAT HE / SHE HAS FULL AUTHORITY TO DO SO ON BEHALF OF EACH TRAVELER.

CLIENT AGREEMENT
“I, the client, acknowledge that I have voluntarily applied for the trip as specified above. I understand that I may travel to remote countries and areas in Africa that are inherently risky including the stated destinations in my itinerary. I am prepared to assume the risks associated with this trip including: forces of nature; pandemic, epidemic, plague, weather; terrorism; civil unrest; war; strikes; local laws; accidents; and all transportation including land vehicles, boats and aircraft that are not necessarily operated or maintained to standards found in North America. I assume all risks associated with altitude, illness, physical injuries sustained, disease, alcohol consumption, physical exertion and sporting activities, knowing that access to evacuation and/or suitable medical supplies and support may not be available. I also assume full responsibility for my own baggage and personal possessions and effects. Guided Safaris, Inc., including its officers, directors, shareholders, employees, agents and successors, does not own or operate any entity which is a service provider for client journeys. I understand and agree that Guided Safaris purchases all transportation, accommodation, dining and all other services from a variety of independent entities. I understand and agree that Guided Safaris is not responsible or liable for the gross negligence or intentional acts by any service provider or other third party. I agree that I am responsible for purchasing comprehensive travel insurance and emergency medical insurance that will cover all expenses related to trip cancellation; missed connection, illness, change of mind to travel, loss of luggage and personal effects; medical expenses including evacuation; and all other issues related to personal reason, personal injury, death, property damage, or other loss, accident, delay, inconvenience or irregularity which may be occasioned by reason of (1) any wrongful, negligent, willful or unauthorized acts or omissions on the part of any service provider including airlines, hotels and restaurants, or their employees or agents or any other third party (2) any defect or failure of any vehicle, equipment, aircraft or instrument owned by any service provider (3) any wrongful, negligent, willful or unauthorized acts or omissions on the part of any third party. I understand that unforeseen events beyond the immediate control of Guided Safaris may occur, such as flight/train/boat/other transportation cancellations, destination issues, weather issues, political issues, hotel issues/problems, and other unexpected schedule changes. I agree that Guided Safaris is not responsible for such unanticipated and uncontrollable changes, and that any expenses resulting from such changes (e.g. additional hotel, transportation, or guide fees, etc.) would be my sole responsibility, and I further understand that I may be eligible to recoup such costs from my chosen travel insurance carrier. I hereby agree that everyone in my party, including myself, is of adequate health, and no one has any physical condition or disability that could prevent them from taking part in the journey or present a hazard to themselves, or have, hereby, disclosed any conditions that may hinder our/my ability to endure the exertions of this trip. By accepting this document I agree to take full responsibility for my own and the members of my party’s actions, safety and welfare, including unanticipated events including injury, illness, theft, emotional trauma, death, forces of nature, war and terrorism. I hereby release and discharge Guided Safaris, Inc. and its agents and employees from and against any and all liability arising from my participation in the above trip. I agree that this release will be legally binding upon me, my heirs, successors, assigns and legal representatives, it being my intention to fully assume all risk of travel and to release Guided Safaris, Inc. from any and all liabilities to the maximum extent permitted by law. For information concerning entry requirement, visa or inoculations to the destinations applicable, Guided Safaris recommends contacting the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, Guided Safaris recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. I assume full and complete responsibility for checking and verifying any and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s) prior to putting down a trip deposit. It is my choice and responsibility to obtain any vaccinations or medications for travel and will consult my medical professional familiar with my health history if these are advised for my health conditions. Any issues or claims relating to terms and conditions or in any way relating to the journey shall be settled by binding arbitration in the State of California, in accordance with the current rules of the American Arbitration Association.”
CLIENT AGREEMENT FOR ALL CREDIT CARD PAYMENTS:
“I, the cardholder named in the Guided Safaris credit card authorization document, accept that my deposit payment is non-refundable and all payments received by Guided Safaris, Inc. (CST # 2090406 40) for the travel services purchased on the indicated credit card constitute my acceptance of the Guided Safaris Booking Contract & Service Terms on behalf of each traveler participating in the trip being purchased, whether or not I accompany them on the trip. I further accept that upon receipt by Guided Safaris, Inc. of the signed and dated Credit Card Authorization form all travelers are subject to the Guided Safaris Inc Service Conditions and Cancellation Terms provided. I verify that all information on the Credit Card Authorization is correctly provided, and that I, the signed Cardholder, am the cardholder of the above credit card. My signature also implies that I, the cardholder and/or my travel companions agree not to request any charge backs on the credit card until any disputed matters are resolved with Guided Safaris, Inc. and travel service providers that have undertaken this booking. I further verify that the signature above is my signature as indicated on the reverse of the above-indicated card. I acknowledge that full payment is required per the dates specified in payment terms attached to my confirmed itinerary and that GUIDED SAFARIS reserves the right to CANCEL bookings without refund for which full payment has not been received by the dates outlined in the payment terms. I also accept that if any payment is withheld by my refusal to pay or by the credit card issuing company, or a bank, either due to limits on the type of credit card held, invalid account balance, insufficient availability of funds or ANY other reason stated by the bank, credit card authorizer or merchant service, this payment must then be made to Guided Safaris via an alternative functional credit card on the same day or EXPEDITED VIA SAME DAY BANK WIRE, PLUS any late payment fee or changes in pricing stipulated by Guided Safaris when such payments are not duly processed on account of credit card limitations. “
CLIENT BOOKING TERMS
The advance payment, all forms of deposit OR any other partial payment for a reservation on a travel package constitutes consent to all provisions of the standard Guided Safaris Booking Contract as attached to this document. These standards terms under which you agree to purchase Guided Safaris services are non-negotiable.
These booking conditions form part of the contract between the Client, travel participant(s), primary cardholder or trip sponsor, referred to below as ‘You’, Your’, ‘The Client’, ‘Traveler’, ‘Passenger’, ‘Primary Cardholder’ or ‘Guest’ AND GUIDED SAFARIS, INC., a registered Seller of Travel in the State of California (CST. 2090406 40), referred to below as ‘GUIDED SAFARIS INC’, ‘GUIDED SAFARIS’, ‘we’, ‘us’ and ‘our’, for all travel arrangements reserved on behalf of the Client.
The non-refundable deposit and current trip total amount to be paid by or on behalf of the travelers for the services is as quoted to the traveler and stated on Page 1 of the Booking Form and Contract provided to the Client, as agreed upon and signed by the Client, Traveler, or Primary Cardholder, in the Guided Safaris Booking Consent and Credit Card Authorization form, plus any amendments or additions of services to the finalized itinerary as requested by the Client. While not a normal occurrence, prices are subject to change without any prior indication by suppliers due to increase in rates, airfares, transport rates, exchange rates, government tax or newly-imposed levy, VAT implementation etc, which are outside our reasonable control. GUIDED SAFARIS reserves the right to cover increased costs, tariffs & taxes and to reflect fluctuations in foreign exchange markets. GUIDED SAFARIS reserves the right to cancel bookings for which full payment has not been received by the dates outlined in the payment terms. For all payment via credit card: Travelers understand that if any payment is withheld by the credit card issuing company, or bank, either due to the type of credit card held, invalid account balance, insufficient availability of funds or any other reason supplied by the credit card authorizer or merchant service, travel payment must then be expedited to GUIDED SAFARIS via an alternative functional credit card, or overnight check, or expedited bank wire within the next day, plus any late payment fee or changes in pricing where applicable when such payments are not duly processed on account of your credit card status or lack of funds.
1. Cancellation Policy: All trip payments are non-refundable. Cancellations policies for each trip are outlined in your issued Travel Documentation and Guided Safaris Payment Invoice.
2. Limitation of liability: The client understands that GUIDED SAFARIS is not the source or supplier of the travel services requested, and acts solely as a reservation agent for the actual suppliers of such services. Client is advised that the suppliers whose names appear in the itinerary information supplied (such as hotels and airlines) are those who are responsible for actually providing and carrying out the travel services purchased. Client consents to and requests the use of those suppliers and agrees not to hold GUIDED SAFARIS responsible should any of these suppliers: i.) fail to provide the travel services purchased; ii.) fail to comply with any applicable law; or iii.) engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience. Client accepts that GUIDED SAFARIS is not responsible for, nor will client attempt to hold it liable for, any injury, damage or loss suffered by travelers on account of any conditions, actions or omissions that are beyond its reasonable control. Client will review travel documents for accuracy upon receipt and understand that they may contact GUIDED SAFARIS if they have any questions. Client understands that special elements of trip cost such as Gorilla permits air fares and special hotel packages are non-refundable from the time of first payment made for any trip purchase. Client understands that discounted fares typically involve restrictions and that changing any aspect of travel arrangements may result in the payment of additional money. Client understands that if traveling internationally, all travelers must have a valid passport and depending upon their destination and nationality, client may need to obtain one or more visas and in special cases, such as travel with minors or adopted children, special requirements or inoculations must be acquired depending on the destinations visited and it is the sole responsibility of the Client to research and be aware of these entry requirements. For security purposes, GUIDED SAFARIS does not assist with Passport, Visa applications or medical / vaccination advise, as these fall under the responsibility of the traveler to ensure that the requirements for entry are met for their final destinations based on their personal immigration status for each destination. Passport and visa information may be obtained by contacting the Travel Advisory Section of the U.S. State Department at 202.647.5225 or by visiting the State Department’s Web site at www.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entry requirements. Client must ensure that all passports are valid for 6 months to the point of return to the home country and that all passports have available the mandatory blank pages marked ‘VISA’ at the top (4 empty sides: 2 facing blank leaves) as necessary for South Africa plus additional VISA pages per each African Country visited, European entry, or other transit point. Each entry to a country requires entry stamps for which passports must have available sufficient blank pages marked ‘VISA’ at the top or this will prove difficulty and possible rejection of boarding aircraft or gaining entry at a border thereby interrupting a trip. Travel insurance does not cover immigration eventualities on barred entries so it is mandate that Travelers call their local consulate to determine the entry requirements for each destination based on their nationality. Travelers may be refused boarding or disembarked from a vessel without liability for refund, payment, compensation or credit of any kind if they or their companions do not have necessary or proper documentation, and the Client will be subject to any fine or costs incurred by Guided Safaris which result from their lack of or improper provision of documentation or noncompliance with applicable regulations.
3. Insurance: It is a requirement of all safari camps that travelers carry travel insurance prior to their departure to protect their personal safety and trip investment. The following coverages are recommended: Trip Cancellation and Interruption, Medical & Emergency Evacuation, Accidental Death & Disability, Baggage Delay, Loss & Pilferage. If a Client declines or decides against the purchase of any form of travel insurance he or she assumes all responsibility for own travel risk protection and emergency arrangements if encountering problems or personal losses before, during or after the trip regarding these services or destinations and accepts that if any emergency assistance is required with re-scheduling, re-planning or re-routing services due to interrupted travel, regardless of cause or reason, that they and all travel companions without any form of trip cancellation or trip interruption protection insurance assume out of pocket expense to resolve their travel arrangement and the Client will be charged an emergency assistance fee where applicable. The Traveler also assumes responsibility for any applicable out of pocket expenses, cancellation penalties or change fees as charged by the airlines, hotels or other suppliers at time of such change of travel plans or emergency.
4. Refund for unused services & Limitation of Liability:
No refund or exchange can be made in respect to accommodation, meals, sightseeing tours, transport or any other services, which are included in the travel package rate but not utilized by the traveler for whatever reason. There will be no compensation from changes, change of mind or cancellation if the same are due to health concerns, natural disasters, civil disturbances, quarantine etc. of which the suppliers concerned have no control. GUIDED SAFARIS is not liable for any act of omission, default or defect of themselves, their employees and agents, for any loss, damage or injury to persons or goods however they may be caused and also for the accuracy of any information forwarded by the travel services of their agents. Seller of Travel Program and Declaration of T.C.R.F: California law requires Sellers of Travel to have a trust account or bond. GUIDED SAFARIS, INC. has a trust account (CST # 2090406-40). Please be advised that the State of California has established a Travel Consumer Restitution Fund (T.C.R.F) pertaining to domestic travel purchased in the United States by residents of California and this is the statement we are required to provide to travelers, under the law: “T.C.R.F. does not cover non-California residents, and even in the case of California residents, T.C.R.F. does not cover ANY foreign travel where the foreign “Providers of transportation of travel services” are not in compliance with the Seller of Travel law (compliance being defined as: Registered as a Seller of Travel in California and a Participant in the Travel Consumer Restitution Fund). Since GUIDED SAFARIS, INC. is a California Corporation we are required to inform travelers of the existence of T.C.R.F. yet at the same time inform travelers that it does not apply to this particular service and travel package where the suppliers are foreign corporations that do not conform to T.C.R.F. Thus none of the trips offered by GUIDED SAFARIS, INC. are applicable to T.C.R.F and by law travelers are required to be advised that they would not be eligible to make any claim from T.C.R.F in the unlikely event of default by GUIDED SAFARIS, INC. or any of the foreign suppliers rendering these services.” Travelers understand that they must purchase travel insurance to fully protect their trip investment from supplier bankruptcy and default.
5. Transportation:
Airlines and other carriers concerned provide transport timings. Per the conditions and terms of carriage listed on any airline website that form a direct agreement between the passenger and airline, or where applicable the terms on the eticket documents issued, services are subject to change as a result of international and domestic air traffic control restrictions, weather conditions, operational /maintenance requirements & the requirement for passengers to check in on time. GUIDED SAFARIS cannot be held responsible for if there is any change to a departure or arrival time shown in their website, itinerary or on any ticket. Similarly, we cannot make any special arrangements if a Traveler is delayed since such matters are at the sole discretion of the airline or any other carrier concerned. Per the terms of carriage of any international and domestic carrier: Airlines are not to be held responsible for any act, omission, or event during the time passengers are not onboard their planes or conveyances. International air carriers are also subject to international air conventions limiting their liability. These limitations are explained on the reverse side of the airline ticket or on the companies’ official websites which constitutes the sole contract between the airlines and their passengers. Please re-confirm your onward flights with the outgoing carrier at least 72 hours prior to departure. Traveler understands that they may purchase travel insurance to cover for missed connections.
6. Participation:
Travelers understand that they must purchase travel insurance incase of inability to travel due to a health concerns, medical reasons or personal emergency. Travelers undertake to ensure that they will seek all appropriate professional medical advice prior to departure as to whether or not they are fit enough to take the trip booked. Persons not fit for long trips due to age, disease, medical operation, illness, physical handicap, advance pregnancy or mental illness should NOT participate in these rigorous travel programs. Travelers must consult a physician for advice on the appropriate Malaria prophylactics available prior to departure: GUIDED SAFARIS is not a licensed medical professional and is unable to provide advise, share any recommendation or suggestions on Malaria prophylactics or vaccinations and whether or not they would be advisable based on travelers’ medical history. 7. Risks & Indemnity: Per the standard indemnity clauses issued by all adventure retreats and game lodgings in your itinerary, GUIDED SAFARIS draws your attention to the fact that there are inherent risks involved in the destinations visited and that you accept them at your own risk. All adventure travel and safaris involve close encounters with wild animals during game activities as well as during stays at camps/lodges since all properties remain unfenced so as not to disrupt animal migratory patterns and retain the authenticity of the wilderness experience. Travelers are advised to follow the advice and guidance of the camp managers and game rangers while on safari and practice all safety procedures as outlined. All Clients acknowledge that they are fully aware of and agree to participate in these journeys given the reasonable dangers and risks that are associated with game reserves and/or game lodges arising from the presence of wild and dangerous animals, reptiles, birds, vegetation and insects and the risk of suffering bodily harm, injury, death and/or loss which may arise as a result of an encounter with and/or the presence of wild animals and/or reptiles and/or birds and/or vegetation whilst on safari.
8. Force Majeure:
This means, in relation to GUIDED SAFARIS, any circumstances beyond the reasonable control of GUIDED SAFARIS [including but without limitation, acts of Nature, explosion, flood, tempest, fire, accident, war or threat of war, sabotage, terrorism, civil disturbance, requisition, sickness, quarantine, epidemic, government intervention, weather conditions or other untoward occurrences. The right is reserved to alter or modify itineraries or hotel accommodation in any way necessary, and to cancel the same without any notice in the interest of Guest safety. If GUIDED SAFARIS is affected by Force Majeure it shall notify you of the nature and extent thereof. GUIDED SAFARIS shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. Traveler understands that they should purchase travel insurance to protect their trip investment.
9. Special requests:
Special requests (e.g. diet, check in, check out, allergies, specific room, seating, etc.) must be put in writing to GUIDED SAFARIS. We shall forward it to our suppliers, however, no provision of a special request is ever guaranteed and remains at sole discretion of the camps, hotels or airlines concerned and their ability to fulfill the request.
10. Luggage & Passenger weight:
Luggage is restricted to 20kg (44 lbs) for South Africa or 15kg (33lbs) for East Africa maximum per person and only soft duffel bags will be accepted (no hard suitcases or attaches may be transported). Weight allowance includes camera equipment and hand luggage. All passengers weighing 100kg (220 lbs) or more must advise GUIDED SAFARIS in advance as extra seating will need to be invoiced by airlines to Travelers for aircraft configuration and passenger safety purposes on the smaller aircraft and helicopters to camps and islands.
11. Physical Fitness for Adventure Travel & Guest Conduct
Clients acknowledge and understand that adventure travel requires reasonable to high levels of fitness depending on the selected activity. To participate in any trip as intended, clients must ensure a reasonable level of sound health and ability for active fitness as required. Guided Safaris requires advance notice if any client or travel participant has any kind of physical impairment or other condition or disability that could impair the client’s ability to participate in a journey or that may pose as a hazard to the client themselves or any other traveler. Guided Safaris reserves the right to decline participation by anyone whom it considers unsuitable due to fitness level. By trip purchase or through payment of any form of deposit, the client certifies that they have ensured that neither they nor anyone traveling with the client has any physical or other condition or disability that could create a hazard to themselves or burden other members of the trip. Guided Safaris reserves the right to decline acceptance of anyone whom it considers unsuitable on the safari due to fitness level or illness. Guided Safaris and its travel service providers, guides, pilots and lodge managerial staff also reserve the right to remove from the trip, at the participant’s own expense, anyone whose physical condition or conduct negatively impacts the enjoyment of the other guests, creates a nuisance or jeopardizes safety while in the presence of wildlife or disrupts the safari. For special activities such as Gorilla tracking any guests exhibiting signs of respiratory or flu symptoms will not be allowed to participate in any activity in the park at the discretion of the guide. No refund or compensation will be issued under any such criteria requiring the dismissal of a client from a trip or activity, whether due to client’s personal constraint in choosing so or under supervisory intervention.
ALL TRAVELERS HEREBY DECLARE THAT THEY HAVE FULLY READ, UNDERSTOOD AND ACCEPT THE ABOVE GUIDED SAFARIS, INC. BOOKING CONTRACT AND TERMS. ANY TRAVELER WHO ACCEPTS THIS SERVICE CONTRACT ON BEHALF OF ANY OTHER TRAVELER PARTICIPATING IN THE SAME TRIP WARRANTS TO GUIDED SAFARIS INC. THAT HE / SHE HAS FULL AUTHORITY TO DO SO ON BEHALF OF EACH TRAVELER.

Governing Law; Dispute Resolution
